Lawyers have criticized a proposed legal amendment that addresses courtroom behavior, saying it will hurt defendants and amounts to a setback for the ruling Communist Party's stated goal of advancing the rule of law.

就扰乱法庭秩序问题的拟修改条款遭到了律师的批评，称这将会给辩护方带来压力，与共产党所推行的依法治国格格不入。

A clause in the proposed amendment says that "insulting, defaming, or threatening judicial officials or litigation participants" and "not heeding the court's warning" can be deemed "severe disruption of courtroom order."

修改条款中有一条为：“侮辱、诽谤、威胁司法工作人员或者诉讼参与人，不听法庭制止将被视为严重扰乱法庭秩序。”

It says that these and "other behaviors that severely disturb courtroom order" would be punishable by up to three years in prison.

条款称有其他扰乱法庭秩序行为，情节严重的处三年以下有期徒刑。

Han Jiayi, secretary-general of the Criminal Operations Committee of the All-China Lawyers Association, said the changes would further discourage lawyers from engaging in debates with prosecutors or judges, something that is already scarce in China's courtrooms.

中华全国律师协会刑事业务委员会秘书长韩嘉毅称该变革将阻碍律师参与到与检察官或法官的争论之中，这种争论很少会出现在中国法庭之上。

Legal experts have estimated that less than 30 percent of criminal cases in the court ever involve courtroom debate.
