Lawyers have criticized a proposed legal amendment¹ that addresses courtroom behavior, saying it will hurt defendants² and amounts to a setback³ for the ruling Communist Party's stated goal of advancing the rule of law.

A clause in the proposed amendment says that "insulting, defaming, or threatening judicial⁴ officials or litigation participants" and "not heeding⁵ the court's warning" can be deemed "severe disruption of courtroom order."

It says that these and "other behaviors that severely⁶ disturb courtroom order" would be punishable by up to three years in prison.

Han Jiayi, secretary-general of the Criminal Operations Committee of the All-China Lawyers Association, said the changes would further discourage lawyers from engaging in debates with prosecutors⁷ or judges, something that is already scarce in China's courtrooms.

Legal experts have estimated that less than 30 percent of criminal cases in the court ever involve courtroom debate.
