Foley: "And I also believe the House would have an excellent chance of winning on the merits of the claim."

Clinton administration attorney Walter Dellinger say the House cannot, on its own, sue the President for routine legislative¹ delays.

Dellinger: "If we were to start down that road, the President could go into court and sue the Senate for failing to give him an up or down answer on nominees²."

While Republicans complain of an imperial Presidency³, Democrats⁴ dismiss any potential lawsuit⁵ as a political stunt⁶.
